         Le marché n’est pas divisé en lots.

         Conformément à l’article 58 de la loi relative aux marchés publics du 17.6.2016, nous décidons de ne pas diviser ce marché en lot étant donné son caractère indivisible.

         Durée du marché: la durée totale du marché est de 4 ans.

         Le marché est conclu pour une durée fixée à 2 ans à dater de sa date de notification. Les commandes émises avant la date d’échéance du marché demeurent exécutables.

         Sauf en cas de notification contraire, il sera reconduit tacitement pour une période renouvelable de 2 fois 1 an. Le nombre maximum de reconductions est de 2, portant la durée maximale du marché public à 4 ans.

         L’adjudicataire pourra notifier au pouvoir adjudicateur, par lettre recommandée au moins 3 mois avant la date d’échéance du marché public, la non-reconduction du marché qui lui avait été attribué. Le pouvoir adjudicateur pourra, quant à lui, notifier à l’adjudicataire par lettre recommandée au moins 3 mois avant la date d’échéance du marché public, la non-reconduction de ce marché.

         Si le marché n"est pas reconduit, le fournisseur ne pourra exiger aucun dédommagement à cet égard.

         Commentaire

         Considérant le marché public «FOD VVVLPLASMADERIVATEN/2017/01» pour le traitement de plasma fourni par les établissements de transfusion sanguine en Belgique et la garantie aux hôpitaux d"une offre suffisante en dérivés plasmatiques stables (solutions d"albumine et immunoglobulines pour administration intraveineuse) fabriqués à partir du plasma fourni, le présent marché ne concerne que le solde de maximum 45 % des immunoglobulines pour administration intraveineuse dont le Chirec a besoin.
