      Het totaal van de uit te voeren opdrachten situeert zich binnen de budgettaire perken die op 1 129 000 EUR zijn vastgesteld voor deze onderhoudsopdracht.

      Dit bedrag is richtinggevend en is geenszins bindend voor de aanbestedende overheid als jaarlijks te besteden budget.

      Bij herhaling van opdracht, zullen bij de herhaling telkens de budgettaire perken aan de opdrachtnemer worden medegedeeld waarbinnen de opdrachten zullen gegeven worden.

      De opdrachtnemer is er evenwel toe gebonden om bij dringende interventies naar aanleiding van averijen, incidenten en calamiteiten en op vraag van de aanbestedende overheid tegen dezelfde voorwaarden van het onderhoudsbestek opdrachten uit te voeren die zich buiten deze budgettaire perken situeren.

      Dit geldt onder andere voor de dringende herstelling van schade veroorzaakt door derden aan de waterlopen, wegen en hun aanhorigheden en aan de kunstwerken.

      Indien deze nieuwe onderhoudsopdracht voor een bepaalde periode overlapt met de lopende onderhoudsopdracht, kan hiervoor geen schadevergoeding geëist worden.

      Door zijn inschrijving verbindt de opdrachtnemer er zich evenwel toe de hem gegeven opdrachten uit te voeren tegen de eenheidsprijzen en totale prijzen van de posten van de samenvattende opmeting.
