         Hoewel de concessie van een openbare dienst een administratief contract is, dat in de huidige stand van de wetgeving, niet onder de werkingsfeer van het overheidsopdrachtenrecht valt, hanteert het stadsbestuur van Deinze, bij de toewijzing van onderhavige concessie, de algemene rechtbeginselen dewelke aan de overheidsopdachtenreglementering ten grondslag liggen ( oa. het gelijkheidsbeginsel en de beginselen van behoorlijk bestuur).

         De concessieovereenkomst voor het beheer op het parkeren 2017-2019 omvat het beheer van het parkeren op het grondgebied van Deinze, incl de deelgemeenten, met name:

         — het beheer van het betalend parkeren,

         — de volledige exploitatie van het betalend parkeren op de openbare weg,

         — de controle op het parkeren met beperkte parkeertijd,

         — de controle van innames van het openbaar domein in de zones met betalend parkeren of met parkeren met een beperkte parkeertijd.
